Not all class actions benefit just the lawyers. Some class actions have resulted in product recalls and in some instances full refunds.

Certainly the attorneys make a killing when they win these cases, but the consumers also benefit.

And for each case in which the end consumers actually got something worthwhile as a settlement I'm sure there are hundreds (if not thousands) that run exactly the opposite way.

Three (personal) examples off the top of my head:

1. Epson class action for excessively wasting ink resulted in what? A $70 credit at the Epson online store, which wouldn't even buy one complete set of ink cartridges for my printer at their prices.

2. Equifax (don't remember the details) settlement that was three "free" months credit reporting. If you happen to forget to cancel after your free ride... Well, I'm sure that was their hope, eh?

3. AT&T long distance gouged customers for years with bogus 'government mandated fees". The settlement? A $5 calling card.

Similar to #2 was the NetFlix settlement for slowing down shipments to heavy users. Free month(s) of service that reverted to charged accounts instead of just expiring.

Care to guess what the attorneys walked away with in each case? Thats right, cash.

The system is inherently f-ed up. But since the vast majority of law "makers" are also lawyers its not likely to change any time soon.

^^ The Epson credit was only $40 or $45 dollars.

We can certainly get into philosophical debates about what is right or wrong with corporate ethics and the legal system. And certainly they both have major flaws.

Bottom line is it's been over 10 months and still no reliable and solid fix in consumers hands. Instead there have been a wave of firmware updates, sub-mirror adjustments, lots of "we've never heard of this", and no official apology other than "we have heard of some problems and are investigating." And the latest promise about a "solid fix" has been from the rumor mills because it was announced only to Canon's elite customers. Almost as if they are saying "Let the regular folks hear of it as it trickles down." Nice....

Yes, it's just a camera, but it's a camera that you reasonably expect would perform to a level that the manufacturer promoted.

So if you are unlucky enough to have a defective MkIII, what do you feel is enough time for a fix? And how much of your time and resources are you willing to sacrifice for a company that doesn't seem to care too much about your suffering.

Rob's site has been an excellent source of information, and I don't think I would call his site a rumor mill. If it came from DPReview, then I would have my doubts.

A third party site - Nothing official from Canon for the general consumer since end of November. I'm sure they are loathsome to the idea of making a press announcements or official letters to MkIII owners, as that would draw too much attention. Better to let it trickle out through web sites.

My experience with the camera is the center focus point will be on the target, the first frame will be in focus, the second frame is focused 3 to 5 feet in front of the target and will be focused on the ground, the third and fourth will be completely out of focus, I mean nothing in the frame is focused, then all of a sudden I will get a couple of frames back in focus again before it goes out again. Pretty hard to do my job with a camera like this.

This is my experience exactly.

I declare both of these people to be lairs!!!!!!

My camera is into Canon and I have been told throughout hours of calls to them over the last month that I am the only one having these problems. Canon wouldn't tell me an untruth so it is obvious that these people are just trying to steal my uniqueness and that hurts. They are just mean, bad people who should be out taking pictures instead of complaining and sending in their cameras for unneeded repairs. Geez, why don't they just switch to Nikon if they are so unhappy.

Just got this email from Canon this morning after I emailed tech support about my Mk3:

Thank you for your inquiry about service for the EOS-1D Mark III. We
value you as a Canon customer and appreciate the opportunity to assist
you.

We are aware of reports on websites about a secondary fix for the EOS-1D
Mark III. However, at this time we do not have any information
regarding this from Canon USA. At such time this information is
provided to us, any cameras currently in for service will be adjusted
accordingly.

Please let us know if we can be of any further assistance with your
EOS-1D Mark III.

Thank you for choosing Canon.

Sincerely,

Renee
Technical Support Representative

Alistair,

Good call, I agree with you completely. My guess is people who are entrenched in Canon equipment are waiting this one out. My MKIII works well enough that it can be used in many situations. In the instances where it does not, I use the MKIIN. I would imagine there are some with unlimited credit lines, or a ton of disposable income who will move. There are also some gadget heads who must have the latest, jump ship, but they probably would have anyway.

As far as Pros.....keep this in mind......"No photographer, who earns his living with a camera, would ever trust his business to a new camera". This includes the D3 Nikon as well. I would hazard a guess; Nikon Pros are holding on to their D2s as backup to the D3 until the fat lady is at least warming up.

I still have faith Canon will sort this out and make most of their customer base happy. I understand the frustration of those who only own a MKIII. If this is your only pro body, every week that goes by makes it more difficult to keep the faith.

As a Nikon shooter I can only express my sympathy over the problems yall are facing. However, I can say that I have come across several other shooters here in the Atlanta area who have recently made the switch to Nikon (I'm not sure if it is because of these problems or the high ISO capabilities of the new bodies).

I can also state that it has recenly gotten difficult to get good deals on used Nikon glass. Normally this is a slow time of year for used glass (with holiday bills forcing folks to sell good glass on the cheap). Market demand seems to be rising and prices have risen as a result.

Yesterday I was out shooting at my local wildfowl reserve with a couple of mates, one of has just bought a D3, he upgraded for a D200. I must say the only feature of the Nikon D3 which made me turn Dulux 'Envy Green' was the LCD display. On every Canon LCD I have only used it to check the histogram and check that composition and focus was close enough. Close enough with the Canon LCD is about all that is possible and I was very surprised to even see intricate feather detail on the Nikon display, very impressive. I hope on the 1D3 replacement we Canon brigade get a similar feature.

Was reading on this thread about people having focus problems with the face in focus and nothing else....I was going throuugh my "ONE shot" studio shots and noticed these two shots where there eyes look in focus but the bodies arent. Theses were taken at f5.6 with center point focus

What do you guys think?

Not as many as Nikon would like and more than Canon wants to admit losing. Watching the B&S as well as frequenting the Nikon forum has shown a number of FM users who have made the switch. The problem for Canon is that 1 angry customer does more damage than 50 happy customers can undo.

Personally, I am ready to switch because I need a camera that does what I need it to do now. Even though I asked their leader nicely, tens of thousands of snow geese who stop regionally on their migration aren't going to hang out around here longer because I have camera problems. I tried to get the Philadelphia Flower Show pushed back their opening to allow Canon service time for a fourth fix but they didn't listen. Much more importantly, I have a dear friend who I am photographing who won't be with us in six months and God doesn't appear to be listening to my pleas (which involve far more than a stupid camera). Time really does matter to me, more than having F4 zooms with IS.

I am sure that Canon will get it sorted out eventually but they are working on their time frame, not mine.

We could only dream...
When I called Canon about my Mk3 shots looking soft and out of focus the first thing he said was "are you looking at the display or actual pictures?" HA!!! Kind of tells you something about that fantastic display it has. (sarcasm)
