I did speak with someone from the University's athletic department. Since I was offering this print to a limited group (Marching Band members), they didn't have an issue with it and considered it "under the radar".
Thanks again for feedback at the time. Not as many sales as I'd like, but they do represent my first "official" print sales. I may be biased with two kids in the band, but the Marching Band is certainly performing better than the team
Bob, just to clear up confusion in posts to come I am sure, it breaks down like this.
The NCAA does not want anyone to profit off of NCAA student athletes other than themselves (NCAA) their schools, and that is it. It can risk students eligibility according to the NCAA. That being said, the NCAA can not police all the schools, sports, websites, etc, so they leave that to the individual schools to police. Some schools do not have a problem with it, some schools have a problem with it, some schools interpret the rules correctly, some do not, some schools just do not know period. If you have the ok from the school themselves, you are ok, unless the school gets a message from the NCAA that the photos are in violation (basically someone bought a photo from you and turned around and did something other than personal use with it and the NCAA caught wind of it).
So, as for the Marching Band, do they have eligibility like sports? The only thing I could see that might be a flag is the logo on the field and in all honesty, that is covered up pretty good. If the school SID is ok with it, your good.
Thanks for the response Carl. No eligibility issues for MB as far as I know. The guy in the athletics department did see the image, by the way. I guess I was half expecting some semi-formal limitations... but he really didn't sound very concerned at all.
How big is that band, Bob? Looks smaller than what I might expect from MN. Either way, be biased about having kids in the band! It's awesome, isn't it?
