I just got a request from a local "celebrity" that I shot for a magazine story. The magazine was published months ago, but it happens that she really loves the portrait of her, and just asked me to buy the rights to it. Now, I've sold photos here and there, but haven't been confronted with this situation yet.
First, she said she would like to use it in a magazine that is quoting her. She said I would be credited. So, should I still ask for a fee, even though I'll be credited?
Second, she said she wants to buy the "rights" to use it as her headshot. What different types should I propose to her? Would she need exclusive rights for that, or is there something else that would work, and I would retain rights to it as well.
And finally, what kind of fees would you propose I ask her for?
Can someone please help me out with this one?
Thanks a lot!
First question is what rights to the photo does the original magazine where her photo appeared have? I'd have thought you'd turned the rights over to them when you provided the photo. Did you get paid for it?
I see that you're in Canada, and ownership there is slightly different from the US. I think it's more in your favor, but I'm not sure.
