taking pics with the 85L mounted on the 40D, I got the error99 I experienced like 2-3x on my former camera, the rebel xt -
having followed the instructions in the menu/manual and the usual thing, the error99 was still there -
is it a common issue?
the camera was purchased just a month ago !
(pls do not tell me to use the search function - )

I am getting different issue with 40D/85L mk II, sometimes it shuts off (40D) with battery too low indicator while AF. Restarting 40D helped for a while, than again same issue. Same lens works amazingly good on my 5D.
85L doesn’t like 40D much ) try another for some days; also make sure you got latest firmware for 40D installed.

I'd see if the retailer still has a return policy. I'd ship it to them, and have them ship a new one. Not sure if they will after 15 or 30 days.
All I know is, if I buy a brand new camera over 1K$ in price, and a month in it dumps on me, Canon better send me a freakin' t-shirt or something for my trouble.
Since the camera is only one month old call Canon service and get them to issue you a call tag for shipping, and when you get it send the camera to them for repair. It bites I know but remember it is electronics, made by men that can make mistakes so these things do happen from time to time.
I just had a $3000 television die on me after three weeks. I'm glad I bought it locally because all I had to do was take it back for replacement. Had it been over a month old, I was told it would have to be serviced.
The new firmware should fix the 85 L issues too (according to canon). Give it a try, and if you keep getting errors, you still have plenty of time to get it fixed under warranty.
