Hi,

I'm not sure if this appropriate for this forum but I need help and commiserations. I don't want to bias your opinions but please take a look at this auction (item # 150202044136) and let me know what you think. Does it seem okay?

Obviously it has finished and equally obvious is that I was the winner. However, the seller now that he has my money has gone very quiet. I have contacted Paypal/ebay/FBI etc but don't have much hope. My real concern is how to recognize & prevent this kind of fraud. This auction did not raise any bells when I looked at it and I did this many times before bidding. The seller did fail to note that the camera in the photos is a IIN model not just a II but I have seen that before. In hindsight the only question mark is that this is the first time this individual has sold rather than bought on ebay.

Your comments would be greatly appreciated

I would not have bid- as you say the seller has 50 positive feedbacks - but all as a buyer not as a seller. It is very easy to get positive feedback in this way buy buying small items.

Mind you - we all have to start somewhere to build up feedback so it is unfortunate if the first item someone sells is an expensive one as it is difficult for buyers.

The fact the "box has taken a bit of a beating" is odd as well - why would you have a camera of this value lying around in a box taking a bit of a beating. He says he purchased it from a seller with the intention of keeping it and it is new. You would not normally say "from a seller" if it were new - just that you had bought it. If he bought it with the box like that it seems unlikely it was new.

Maybe he just found the box in a skip?

20/20 hindsight is a wonderful thing

Not sure if this is a sensible suggestion - perhaps get a friend to email him and ask to be informed if the sale falls through - if he responds to that you know he is a crook.

Thanks Paul, I know quite a few people who make a big deal about selling cameras with all the bits & pieces, including the useless box. The appearance could have from sitting on a shelf. Most thieves don't have time to post images or even a description. Lots of little things but not enough to make me suspicious.

The individual has a Paypal account but the name on it is not real. I know this because I contacted some of the sellers he used to make that 50 positive feedback. Fortunately for me, the only other auction where he was a seller, a Canon camcorder, was purchased by a law-enforcement officer.

I would have contacted and asked him questions before the auction. I would have liked to have known if there's a receipt, when and where purchased, etc., why there are extra batts in the picture....

But barring no response, I wouldn't necessarily have avoided it--there are pics, etc.--might ask for better, closer up ones. I take it he's gone silent for a very long time, like a month, without providing tracking information. Sorry to hear that.

Always bid on buyers with paypal protection that covers the cost of the item, in this case $2000. This seller has no buyer credit and paypal only covers $200. No bid for me, too risky and waste of time just trying to get your money back. Talking to the police or the FBI is useless, this is not a priority on their list. The auctioned ended over 2 weeks ago, you should having on hand if was an honest seller. A good seller will have camera on your hands by Wednesday, insured and inform you with tracking number.

There may be some recouse available to you, but as you said it does not look too good or "easy". What did PayPal tell you? If you make a claim for non-delivery thru PP, they can "attach" the sellers account and block further activity. I would suggest that you attempt a phone call to PP. And at the very least get what ever info they have. And yes, PP is a b**** to deal with much of the time. btw did you use a CC thru PayPal? If so, that adds another recovery venue.

Most importantly, you can pursue this thru the sellers local area small claims court and get a court confirmed claim against the seller. This process may require an attorney but you would be going after the items costs and all related costs (attorney etc). Your case seems fairly be able to clear cut. You have the auction listing, your paypal proof of payment, you have tried to contact the seller. This should be "nbd" for a local attorney who spends any time in small claims court. But I believe there is a 45 day time period that Ebay gives people to settle transactions. So that may get in the way a bit.

The key is to get the court ordered claim. An attorney can "pursuade" Ebay and PP to provide seller information. If the seller used PP, they will be trackable. And I didn't think the auction looked like it was from an organized group of thieves.

Then you can pursue the court claim thru the credit organizations. You then use skip chasers to go after the guy. Once you get to the stage of the skip trackers, you have some pretty dilligent people "on your side". Admittedly they are there for their cut of the money, but in your claim to the court you build in that cost.

It's a bummer to get "stiffed". So maybe this gives you a way to go that will get you some "peace of mind" and maybe some money back. You might start by estimating the total cost for your claim at the $2000 plus 4-6k for tracking and recovery costs. Once the $ involved get up to a decent level with the recovery fees, you will get much more support from these resources I have mentioned.

Ebay will also give you the sellers name so you can contact him. I agree that when I bid on something expensive on eBay I always look closely at the feedback as a SELLER and several times did not bid because that feedback was so limited; I don't bid on expensive items on a new seller. I also go with the $2000 protection from Paypal on an expensive item; there is always going to be something else out there.

On the other hand, don't give up. Once I bought a camcorder and I thought I would be totally out of luck but eBay came through for me and I got my money back. Good luck.

I hope you paid with a credit card . I buy everything on a card as that is really the only way to get your money back .

I would not have bid on the item since the seller had relatively no feedback. It was an expensive item and seemed too good to be true. He's replacing the Mark II with a Rebel? It's been nearly three weeks and I'd ask him for a shipping tracking number and then eBay and PP if payment was sent through them. Yes, you will get your money back but not as quickly as you would like. If you used your credit card, your bank should be your first call.

BTW matsuib, it looks like the DC Coupler and battery in the picture. The battery cover is usually on the body when shipped.
