I dropped off a return at the UPS Store a few days ago, I asked the owner about this. He said that the insurance paid for at his store is the same as if you would do it at UPS itself.
I didn't have time to read the entire thread but I would assume the weight of the box would tell the truth if the box was sent with or without a camera.

I am no lawyer, but there might be a argument for fraud here by UPS. If they charged you $x.xx amount for Y coverage, then the expectation there is that you are covered for the amount that you paid for. Insurance companies do this all the time with policies underwritten by individual agents, but if you purchase a policy for $100,000, then that is the face value of the policy.
I would seriously consult an attorney and you might have a larger case than small claims if this is the case.
So now you have to wonder why the OP has no answer almost as much as what happened. Is not like he disappeared of the face of the earth. He posted an item for sale yesterday. Ours is not to reason why.
I am the OP. It appeared that this thread had gone stale and my case is still open so haven't checked back on any new posts. Before I provide an update what I am about to say borders on unfathomable. I sold a macbook pro right here on FM and that too arrived today empty!!!! This was handled deftly by the long time FM'er who bought it and he called me right away and refused delivery. While I was on the phone with him the UPS driver was still there and I asked the driver to keep the box for investigation. I then assured the buyer that I would refund his payment (and did). I then called the UPS store and flipped the F%$& out on them. So back to my first theft (there is a tie-in to this one). I have been strung along with hopes that I will be paid the additional $2500-$2,800 due me. They seemed like they were going to pay and then renege saying that the UPS terms (tariff) say I can't be insured for more than $1k because I used a third party. They are now saying that they are looking to the UPS Store Corporate office to pay me claiming that the UPS Store should have told me that I can only be insured for $1k and should not have allowed me to insure it for $3500. As others have said, I have an insurance contract with them and have said as much but this is where it is at this point. My UPS contact is on vacation this week but I called today to leave a message with this new development. Another person answered and when I identified myself as the "stolen camera guy" she knew exactly who I was. I proceeded to tell her my latest fiasco and she took the information. Needless to say I will follow-up with my contact on Monday and demand they make me whole. I think this may be a blessing in disguise as they cannot in all good conscience deny my claim. After cooling down I then called the UPS Store and spoke to the owner. He said he has cameras all over the store and that they have had problems with missing boxes as of late. All of this should bode well for me. I will keep everyone posted.
Let me get this straight: you got (allegedly) ripped off by UPS on the camera body. I think I got that right. And then you went back to the same UPS store and now (allegedly) got ripped off on the sale of a MBP? Something ain't computing (sic) here.

I figured that the first time was an anomaly. I said to myself this cannot possibly happen again...WRONG! And, this item was just at $1k so insurance was not the issue. I just want to make one thing clear. I detect a hint that you are alluding to my having a hand in this. If this was the case, my MO is to ship a $1k laptop, have it stolen so I can immediately refund the buyer his money. That does not compute.

Absolutely. I am going to tomorrow. The first incident was filed by the buyer in his home state (Connecticut). I called my local precinct at that time who said one report is sufficient so there is no need to file again in Staten Island. This time I'm going down to file.

Sir, with all due respect, I'm "alluding" to nothing of the sort!! It's just hard for me to understand why you'd want to trust those turkeys after an initial crummy (to say the least) experience, sort of in the old adage, "Burn me once, shame on them; burn me twice, shame on me." I agree with the previous poster and head over to your local precinct and file a theft report.
I just got back from the police station. They are telling me that the police report needs to be filed in the jurisdiction where the crime was discovered. I guess the fact that almost $5k in goods goes missing from the same origination point doesn't get anyone too excited. My brother in law is on the job and he called into his precinct and the lieutenant there was not 100% sure what the procedure is so they are checking. He did say that there is a lot of theft at UPS. It is very frustrating that I have to wait until Monday to call UPS again cuz I just want to scream!!

Oh, so you are hinting that I am mentally challenged. I feel much better now Perhaps so for using them a second time and I guess by posting I opened myself up to have my judgement questioned. My rationale for going back is I had been using them for years without incident and they are close and convenient. I really never dreamed that this would happen again. There won't be a third time.
I received a call today from the UPS Security Department in Michigan. They had the box and asked me a few questions. They said that they were going to expedite my refund. I wasn't asked to submit a claim interestingly. I also called my UPS NJ contact to make it clear that I expect to be reimbursed for the first theft. I stated that they have been stringing me along for two months now and that they relinquished their right to deny my claim citing the tariff. I explained that if the tariff was the issue, they should have denied my claim in 5 minutes. I said I did not understand what they were looking for in the last two months and wanted to know why the tariff is even an issue at this point. I also pointed out that they signed an insurance contract with me and they are in breach of that contract. I suggested they consult their legal department on this one. I also asked if the term customer service existed anywhere within their organization? I again was told that they will speak to higher ups who at this point are not willing to speak to me. My point person said that it was her job to act as liaison. Re: the police report. I spoke to my brother-in law today and he said that the precinct has to take my report. It may not be an issue at this point since I am not being asked for a police report by UPS so am not going to push it. Lastly, I did learn today that the theft of the camera is grand larceny and a felony. I will certainly make this clear to UPS tomorrow.
I just received a call this a.m. I am going to get paid, yipee!!. Turns out their insurance company Crawford will pay. I am out $300 cuz I underinsured by that but will take my losses I guess. Hopefully the macbook reimbursement goes much smoother. So if I see anyone on the B&S boards, I have great feedback and will not ship UPS
