A couple of shots taken from the rooftop of the Silver Cloud Hotel on First.

Shooting info on the first: 40D, 28-70mm f/2.8L, 70mm, Tv 1/250, Av 8.0, curves adjusted in PS.

On the second: same camera and lens, 28mm, Tv 1/250, Av 8.0, curves adjusted, cropped for panoramic feel in PS.

Maybe its my eyes going bad but why does the first one look out of focus

No offense, but I agree with Sam. The first one looks like a cell phone photo. The second is better, but only marginally. In the second, I like the composition more, and the colored train cars on the left add a little color to an otherwise dull view. I'm not sure this is the best place to shoot the city from. Too much of an industrial foreground, in my opinion.
