Nope...not new. Been turned down a few times because the receipt is under some elses name. For a few dollars more than your selling it for you can just buy a new one from b&h and save you the trouble of having to prove your the original purchaser. Plus you can return it to B&H if you dont get a sharp copy. What you can do is offer to help with the warranty if you have trouble with any claims.
