p.1 #1 · Second shooter photo rights?

I know this is a person-by-person, case-by-case thing, but just would like to know how you deal with your second shooter's images...

I recently shot a wedding with a good friend, and I was told that I can use the images for my portfolio. She's supposedly seen my previous work, and loves the photos I shot with her at the wedding. Then comes to time when I upload my favorites (~20) to facebook to share, she sent me a message.

She wanted me to not show the photos that she set up, so like all the shots I took over her shoulder, but a different crop/framing... I took some on my own, so I can use those. I credited the album to her photography fan page on facebook, as well as tagging her in some photos. She called and said it was no big deal, but just in case we shoot again. This is perfectly understandable and easily fixed, but just the first time I have been told.

I like to know how much room do you let your second photographers use the images? Nothing at all? Whatever? Whatever you approve first? Just want to get a consensus in case I am in her shoes in the future... Thanks!

Sounds fair to me. Whenever I second I go out of my way not to shoot "over the shoulder" of the primary.

Seems pretty reasonable on her part. I prefer my 2nd shooter not to be shooting over my shoulder but out doing PJ stuff. They can use the images.

Yep. Agree with above. Why shoot what is already caught anyways? My normal second is a beast at different angles of my setups.

I was able to use the images in my print portfolio for the main person I second shot for. I don't remember shooting over her shoulder that often, if at all - then again, she was primarily PJ, so it wouldn't have made sense.

Otherwise it's been up to the people I shoot with. I've had enough work this year to give me plenty of portfolio material, if I'd ever actually take the time to put the photos up on my site, so I haven't even done more than a cursory glance over most of my second shooter stuff.

here is what happened to me and why a contract between the second and first shooter needs to be in place.
Over the summer I shoot about 20 senior sessions for a lady who I used to edit for because she just had shoulder surgery. I told her that I wanted to have a signed contract with her and also a model release on the seniors. She tells me no its ok we do everything on a hand shake and good faith. Um ok not the way it needs to be done in my opinion but since nothing would lead back to me it was her arse the client could sling up if something went wrong. so I do the shoots and then she tries to convince me that the all the images are hers....um no I says because I took them and we have no contract stating other wise. so she gives me a hard time and eventually lays off saying that she just wants jpegs to edit herself etc. ok fine no problem I got paid and its what I do normally when i work for others. then I kindly ask her if I can use the pictures for my portfolio etc, she tells me no again because I did them for her and they are hers not mine. um ok well I guess since we had no model release I cannot blog them or use them on my website but she will never stop me from showing them in private to other potential clients. I digress, one must always always always have a contract and release. I will never ever do anything like that again because I ended up with over 20 sets of pictures that are basically worthless to me.

Honor your situation sounds a lot like mine and it ended up being such a pain that I will never work for her or do any kind of work for anyone without prior stipulations about image usage. Its just to much of a hassle.
Good luck I am sure that it will work out.

Thanks all for the replies!

I guess I used the wrong word... I didn't literally shoot over the shoulder, but more like different angles of the same setup. Still, same idea.

Anyways, I think it's my fault of not giving her enough credit, so she thinks whoever saw the photos thought I was the main photographer. I went back and put her info on all my photos and said this wasn't my wedding, but hers. Hopefully that's good enough...

If you second shoot, how do you usually give credits back to the main photographer?

Usually I don't, and if I do, only if the main said it was OK. I will say the main invited me to shoot with them. Then it's mainly PJ. You can get away with using the pics in the port, but due to the public nature of blogging it's trickier. The main just doesn't want other photos floating around of the wedding perhaps. Gotta try and respect the main since they hired you.
