It looks like a song sparrow, though it could be a savannah sparrow if it has a white or yellow eyebrow. It's hard to see his head markings in this shot. good luck

If by chance you have an opportunity to hear it's call, the Pine Siskin has a distinct call. In my mind it sounds like a cartoon UFO taking off up into the sky, as it's a kind of rising zwheeeeee sound.

By looks alone, though, it does look like a Pine Siskin as the markings continue from his beak down to his belly and he has a short forked tail. Song sparrows have a clear throat with a single side line, and the Savannah Sparrow's markings end further up on it's breast.

it is not a sparrow. - the bill is too thin and the breast markings are not right.

Siskin. In addition to features noted above, neither Song sparrow nor Savannah Sparrow has wing bars.
