So, wait, what does this have to do with Nikon using the Art of Flight clips in their commercial? Because, it's quite clearly the same clip.
Also, have you even seen the Art of Flight? The cinematography was absolutely incredible. They list the gear used on the website http://artofflightmovie.com/news/permalink.php?aid=43. I somehow doubt they'd be lying about the gear they're using. This is Red Bull Media we're talking about--they can afford to have a couple helicopters, planes, cranes and dolleys carted out to the far ends of the earth. I somehow doubt that they filmed it with consumer grade cameras with the 2 million dollar budget the film had.
It's advertising. And, on top of that, it wouldn't be the first time they put out a misleading ad.
-A bit surprised to see Nikon using some of my video clips in the world launch of the Nikon D800 camera in Bangkok on the 7th without contacting me. Especially since Canon is one of my sponsors, and I use a 5DII.
Haha man this is a shame if this is true..Or maybe nikon loaned the camera to those photographers and they never did anything with it but shoot cats and posted it on dpreview..
Don't think Canon didn't do this kind of things. One of the lenswork books for the FD lenses in the eighties was done with the help of Pentax 6x7 camera's and Takumar lenses on 6x7 cm Kodachrome slidefilm, suggesting that the shots had been done with FD lenses on 35mm Now there is really even EOSfun in Nikon campaigns

To a certain degree, I understand that and as long as it was pre-arranged and agreed upon and properly compensated, then it would be more acceptable than the way Nikon did as an after-thought, as described here:

The management in Nikon Japan has agreed to pay Sørgjerd his standard rate times two for the use of his footage and come with an official apology to him (this was what Sørgjerd wanted).
The manager of Nikon Norway says that it is embarrassing that they have used someones footage without their permission and especially embarrassing that it was shot on Canon.
