From a legal standpoint... if i had a virtual agency and shot some images of golf for instance.. and licensed them online for personal use or royalty free, wouldnt i need to have a release for the golfers to post their images online. (I think the answer is yes)
Now what if other people in my agency dont have the release of the golfers should they be allowed to upload to the agency?
Im guessing when Getty Inc. do their deals.. it addresses the licensing of images within the media..
So where does that leave other Virtual Agencies with the same intention?
I think you need a release for any kind of image that will generate income for you or your agency unless it's editorial usage.
If the golfer was shot at a news event (ie a tournament) from public stands, then I think you'd be ok. But if you're credentialed by the Golf club/PGA, whomever, then you're probably restricted in the usages you can utilize. Definitely in the case of advertising.
This would a great question for Photoshelter guys. They're pretty good at getting it right so I think I'd check with them too.
ok, thx
my main concern was; would all event and sport photographers need permission to distribute images in the way shelter does. Rights managed or otherwise...
