the 40D never did worse at night or evening game, and usually better for sure, but sometimes now and then it during days apparently if there was intense backlighting or under really fierce, bright southern noon sun-type conditions
my 40D still to this day sometimes fails under very bright conditions. I've learned to live with it though. It isn't crippling and there aren't that many shots I've missed because of it.

the only bad thing is if a sporting event was scheduled under such conditions, you can't wait for better light, they play when they play
My 40D is better in any circumstances than either of my 30Ds - it outdoes them across the board, and especially in low light, where it'll focus in situations where I can barely see what I'm pointing the kit at: if I can see the subject in the VF, the 40D will focus on it.

In really bright conditions, I'm thinking that there's likely to be more contrast right across the scene, and the 40D's very sensitive AF might be picking up on and getting distracted by contrasty items other than the subject and locking on to them, where it wouldn't if there was less light/contrast - but personally I don't have a problem with this.

on the other hand newer camera should be better then previews one , which was not a case with 40D and its Ai Servo performance in low light the 30D wins hands down. Lets hope Canon makes MK IV a GOOD ONE !!!!!! for you guys , and then I can get MK III after price of it goes down more .
The 50D was a much bigger upgrade of the 40D than the 30D was of the 20D. If the 30D had jumped to 10MP it would have improved it's reception 10 fold IMO.
My 40D is better than my 20D in low light and it's been demonstrated a number of times in reviews the 40D would focus in conditions the 20D/30D could not. The funny thing is Canon still rates the low light AF of the 40D the same as the 20D/30D -0.5EV. To me it seems the 40D should be rated to -1EV.
