Actually, the frame rate doesn't just depend on the mechanism---the sensor density/resolution and the time it takes for the processor to, uh, process those higher-resolution images also plays a big part on this. It is actually quite a feat that they were able to improve the DIGIC IV (50D) processor so much over the DIGIC III (40D) that it can process much higher-res images at almost the same frame-rate.
Question: Is the battery door on the BP-40D weather sealed like the one on the BG-E2N? It sort of looks like it is from your pictures but I can't be sure.
Sadly, no AF-On button, just like the Canon grip, which should have had a proper redesign when the 'N' model was introduced (instead of just some foam on the battery door).
It's odd that none of these knock-off manufacturer's have seen fit to address this obvious shortcoming in the Canon design.

Off the top of my head I don't think so but I dont have the camera to hand. The 40D isn't really weather sealed anyway so it's kind of irrelevant.
Mine does have a foam strip along the battery door. It isn't what I would consider weather sealed, but it isn't any worse than the Canon grip in this regard.
