You may be very well right about the banding in the first image.
I will send the camera to Nikon to have it checked.

Both look great. I think the second gives me a sense of peace more for whatever reason.

Choosing a little bit faster shutter speed, for sure, will give some details in the water flow.
Mark - even though the two shots were done for the same waterfalls, yes.. they render different feelings.
