Like I said, it is shady, but I know I was 100% right and they are taking advantage of customers. But if they want to 'scam' me, I guess I'll scam back. It's sad really.

No I will not do that, though tempting.

My guess of what will happen? I'll finally give in because the lens is screwed (their fault but I'm already $2700 deep), get it sent to the store, test it, still will be screwed, back to service....it will be out of my hands for months on end, camera included

Good thing I have other cameras or I'd be super choked.

I sympathize with you and all the other customers being ripped-off by Nikon. And I think Nikon is running some sort of scam here. But your solution is fraud. And posting on a forum that you purposely filed a fraudulent claim with a CC company is not smart. And encouraging others to engage in fraudulent activities is also not smart. Just because this is the Internet it doesn't mean that laws are irrelevant.

What you're describing isn't just shady it is illegal, in probably more than one way. Not the best idea to means that statement on fun the internet...

Oooh, good idea.

Not the part about the illegal credit card fraud, I mean.

The part about you admitting to doing so, and encouraging others to participate, on a public forum which contains links to your business website, first and last name, contact information, etc.

I mean, I know that if I were a Nikon representative reading this popular photography website, I certainly wouldn't at least make a token effort to find your service record. Also, if I were a customer shopping for photography services, I would definitely want to give money to someone admitting to scamming their vendor. That makes you totally trustworthy in my book.

Honestly, it is pretty obvious that that mount has seen some sort of stress from a drop or other force. I'd like to hear what Roger C. says, but it seems like the lens could be bent vs. the expected plane of the sensor and thus confusing the AF system. That thing is hurt, and not just a little. I think their term "impact damage" is more of a catch-all for "hurt by external force."

I can't say much about the body, other than the lever does appear bent as well and I have to wonder how "square" it is - it doesn't take much to throw off the AF system.

I'm still pretty shocked about this. It would never occur to me to pull something as dishonest and probably illegal as that.

Didn't you know? He feels they're being dishonest so any action to get the resolution he wants is just fine.

I mean, Best Buy absolutely gouges customers on ridiculous, $40 HDMI cables that work exactly the same as $3 cables... so I think I'll just put a few in my backpack next time I'm there. That's okay, right? It's not fair to gouge customers, so anything I want to do at that point is justified.

So you've never downloaded an mp3? Or movie? Or Tv show? Known a friend or family member to do it and not reported them? How about going on someone's unlocked wifi? Have you gotten a speeding ticket? Parked illegally? Not paid a ticket? Gotten away with it god forbid? Before you take the high road on this, maybe a reality check is needed.

Still waiting to get a report back.

The ironic thing about this whole situation is that my 16-35mm took a big drop when I had my camera around my neck and I thought it was engaged on the body, and wasn't. Still works totally fine! I get a lens from the factory with flaws and it's automatically my fault .

Uh huh. Hundreds of dollars in credit card fraud is definitely on the same level as connecting to someone's unsecured wifi.

In any event, I'm not really offended by his choice, I more find it amazingly short-sighted that a business owner would publicly admit to such an action and encourage others to do it as well.

No, but it is illegal nevertheless. You are stealing and that person didn't fraud you to begin with. Ask me if somebody comes into my house and threatens my family if I would do something illegal. I think you know the answer. You'd probably do the same, yet are preaching you should never break the law. Hey, if that is the game they want to play, I'll play it!

I'll continue to take videos and take tonnes of pictures of my camera and mount before I send it in. That way, I will have the proof I need for next time. I still have not paid a cent for any of their "impact" claims and it is only because I detailed log of everything I do that has saved me from this activity. But... I'm NOT above lowering myself to their level to win a fight. Why should the little guy constantly get **it on?

P.S. Your not frauding the credit card company. They will call nikon, ask where the approval was. No approval mean they pay back the money to the credit card company who in turn pays the person back. Credit card company isn't out a dime and IMO nikon gets what they deserved.

What happens when one of your clients thinks you are stealing from them (dissatisfied with the work), and steals it back? Is that okay?

We have three ways to address what you are seeing as theft: a police report, a civil suit, and withdrawing your business / outing poor business practices.

The latter is the most effective in this case.

If you thought their diagnosis was faulty, you could (should) have then refused the repair and taken the camera back, or escalated until you got satisfaction.

I doubt you will be convinced, so am writing for others.

No, I'm not. Read the last sentence of my post again (quoted above). Or, read my original post above.

Who is to say whether Ben is honestly being ripped off? Certainly I don't know whether he dropped his gear down a mountain side and then fraudulently tried to claim it as warranty. The point is not the act: it's only that a business owner, or anyone with their personal information out there for all to see, should be cognizant of what they are saying in the public eye. I think it's foolhardy to admit to a crime, on a public website, in the type of community that your potential customers and the recipients of the fraud are most likely to see it.

That's it. No high horse. No judgement. Whether I agree or disagree with his method does not actually matter.
