A 6 piece instrumental fusion group in KC that plays all original music is putting out a release of 200 new CD's of their music and they'd like to use one of my landscape images for the cover. They used a stock image for the cover of their first CD. They're using "Kick Start" to raise $ for the project and I have the impression that it's fairly low budget. I've outlined a basic licensing agreement which I'll copy below. I'm not sure what to charge for this. I like the project and I'd like to have them use my work but I don't want to short change myself, either. Any recommendations for pricing and for the agreement are appreciated.
In exchange for $____, 3 copies of the CD and 3 copies of the poster, Brian Lingle, dba Brian Lingle Photography, grants _______________ the following use of the image titled, "Sand Creek Sunrise #1":
1) 200 CD covers..
2) Unlimited use on the internet of a copy that is __x__ pixels at 72ppi. (Small size and low resolution so that it can't be reproduced in a good quality print)
3) ___ number of posters at ___" x ___" in size.
4) The right to submit full resolution copies to newspapers and magazines for press releases and similar publicity.
4) All images reproduced in any media will include clearly notable photo credit.
4) No additional use without express written permission from Brian Lingle.
5) Cost for additional copies and/or additional use to be negotiated.
6) Brian Lingle, dba Brian Lingle Photography retains the copyright to the image.
This has cheap written all over it. It'll go like this: You: "$3000." Them: "Are you joking? We're just starting out!" In which case you reply: "That's funny, when I started out I had to buy $20,000 in camera gear so $3000 is a STEAL!" . I don't know what to tell you but I'd just ask them what their budget is prepared for this. Are you dealing with the band directly?
You may want to reword a couple phrases as in the first number four: change to, use limited to public relations, editorial and social media, cuz that's what everyone wants. Number two, drop the reasoning behind the 72 ppi. Other number 4 the band has no control over when or if the publication prints the photo credit in third party publications.
What about any kind of merchandising rights?

The band has paid plenty already - 6 piece fusion - Pro keyboards start at $3000, you'll want two of those, one connected to your macbook pro. Pro sax - $2000-5000. Bass $1500 plus amplification @$1500-3000 and so on.
Charge what you feel comfortable with, if its too much they'll tell you. If it's too cheep it doesnt matter because you picked a number you thought was fair in the first place.
