All of us are to blame for lawsuits wether warranted or not, because we seem to be obsessed with electing lawyers to local state and national public office.
Would you expect a lawyer to limit his/her income potential by advising us that they should not be the ones making laws and ordinances.
Who but a lawyer would have ever thought of suing for not getting sex from a sick or hurt spouse.
Who but a lawyer would want unlimited damages for pain and suffering.
Why do you think lawyers run for public office. Tort reform is seldom proposed by a lawyer.

What I meant is that the plaintiff in such cases had little to nothing to do with the harm that they claim. That is to say, they entrusted their care in a doctor, and the plaintiff believed that the doctor did not care for them appropriately. In most cases (I cannot account for outliers), it's not a matter of who is at fault, because we know that the doctor performed some sort of procedure or took some action. Rather, the argument is whether or not the doctor's procedure or action was, in fact, harmful.
If you truly feel distraught about lawyers and how you feel they're the downfall of society, might I suggest that you take this up with your congressman? Tort reform is still a big issue after the infamous McDonald's coffee lawsuit. Complaining on forums isn't going to get anywhere or do anything for you.
In the end, though, you already have your conclusions and assumptions about me (and can't seem to spell my screen name correctly).

A friend went to law school and he told me that they were attempting to get as many as possible on the Personal Injury track, telling them that if after two years as a PI lawyer, if they did not have their first million dollar pay off, they were not trying hard enough. He said that professors kept telling them its all about making money, and how to do it. I was told, but have not been able to confirm this that one of the classes the Texas Bar offers for Lawyer education is an acting class.

Actually, the law states that if someone enters your house without permission, you have the right to shoot them. However, you are not allowed to shoot them in the back because that would mean they were trying to get away and you pursued them. Also, they have to be IN your house in order for you to do so.
My fiancee's aunt and uncle had an intruder in their home. He broke in through the kitchen and there was a step-down to the living room that he didn't know about (how should he? it's not his house!). He tripped and fell, breaking his ankle pretty severely. Her uncle called the police who came and got him. The intruder filed a lawsuit and won just over $30,000. Is that fair?
I'm guilty! With as many RR shots as I've seen I thought it was a no-big-deal, easy to "see it coming" type of thing and that it was common practice. I'm surprised by this (well, not after reading it all, but pre-reading ignorance). I'm certainly glad that I've stumbled into the thread though as it has certainly changed my perception.
For those of you RR/train buffs... Is there any way to know if a RR track is active or dormant?
