Hmm... close up pictures of a topless 12 year old girl. What if she were 14 or 15 years old. What if there was an older male if the photo. The question is - where is the line to be drawn. Today, in many societies, the line is drawn on the side of caution (even on the ridiculous side of caution sometimes). This, however, is a knee jerk reaction to cases of real pedophilia that are showing up more and more often.

Being a father of four I am concerned about legitimate sex offenders. If you live in the US, check out the sex offenders registered to live in your area http://www.familywatchdog.us/Default.asp - pretty scary.

Was the above incident really worthy of punishment? Probably not, but none of us have all the facts that were before the court.

There is paranoia out there and there are others that are blind to what some of these sex offenders enjoy. This one is hard to say without viewing the actual photos and what occurred during the shoot. I have seen some well developed 12 yr olds though.

I handled a case where a photo employee was very upset about some nude photos of a young boy. The pics were old film and the customer was having them enlarged. I picked up the photos as evidence and contacted the customer.

The customer brought the young boy with her..... Problem-the boy wasn't so young anymore. He was 21 and the pictures were for him and his new wife. They thought they were hilarious and wanted some pics for the wall.

In the end, the business gave me the photos, so the customer never had to pay for them

No - it's disgusting. The pedophilia scare has been going on for quite some time in this country and I personally know 2 men who will be forever shunned, harassed and loathed by getting caught up in this mess of stupid legislation and overzealous "enforcers". One married a divorced woman with 2 daughters. Daughters had a "dream" that her mom would reunite with their dad. When told it wouldn't happen because she was happy with her new husband the kids followed the advice given at school where they basically tell teh kids you report 'em we'll put 'em away. Even *after* the kid admitted she lied they still kept him on the register. The other was involved in a bitter divorce. He wanted joint custody. Wife made up a story about catching him improperly touching their 4 year old daughter. Game over. branded for life. So when people tell me about the amazing number of pedophiles on some Google map I'm very very skeptical of the "facts".

I am with Jon on this. These public lists are a massive source of injustice and do NOTHING to protect children.

I would never photo a underage kid in any sort of undress. Under any circumstances. Not my own kids, not an infant. It doesn't matter a bit if it is artistic or innocent it is too risky in this day and age.

If I had a bath picture of my own kid I sure as hell wouldn't upload it to a photo sharing site.

People are paranoid idiots. And worse still...paranoid idiots vote.

we've gotten to a pathetically sad and insular place in our society when someone's afraid to photograph their own children, and when a judge sentences someone who is known to be innocent.

there are bad people in this world, but what else is new? not everyone is one of them, so why assume they are?

Uninating in public (ie, on a long road-trip letting off a bit of pressure on the side of the road and Mr. Trooper pulls up along side) you can and will be placed on the sex offender database in Colorado.

My understanding is that the reason why the photographer was still "punished" was because he had pled guilty and the judge had to issue some punishment.

I agree with those who think this whole situation is absurd. When I was a baby, my father (who was a pro photographer) shot some pictures of me naked on top of (of all things) a big console TV. Was that porn?

I once saw my 3-year old daughter sitting naked in a big old wooden rocking chair in her room with beautiful afternoon light and grabbed the camera. Was that porn?

We have become insane. Nudity is not pornography. The people who are screwed up sexually are the ones who think it is. It's usually repression that breeds unhealthy sexual outlook and activity. I suppose all those renaissance painters and sculptors would get locked up these days.

But give a kid some toy guns and knives or the most violent video games and no one gives a crap.
