Hey guys, I need some advice about a recent situation. I have been using cloud spot to host my client galleries for about a year or so and have been enjoying them so far. Great interface and it offers more features than my previous gallery platform, including the option to set the download resolution of the images. I had mine set to 2600 which is printable up to 8x10.

They recently made an update to allow more than 1 resolution to download for a single gallery. So for example, I could allow a client to download both a 5mp digital file and a full resolution digital file. I did not know about this update or make any changes to my gallery settings until just a few days ago when I found the problem. Unknown to myself (and their team) it changed the default download option to allow the full resolution digital files to be downloaded.

I allow printing up to 8x10 and have clients order professional prints if they would like anything larger than 8x10. The change happened in mid-March and about 18 of my galleries allowed the full resolution downloads without my knowledge or consent. I changed permissions for the new galleries as soon as I became aware of the issue but these clients have already downloaded the digital files. I normally charge $150 per image for clients to download a full resolution digital file since the assumption is that they won't be printing thru our studio. In addition, while I cannot say with absolute certainty, there is a very high chance that I have been shorted out of hundreds or thousands of dollars of print sales from those 18 galleries. What are your thoughts on this?


EDIT: Thank you for everyone's input so far, To clarify, I am looking for suggestions or actions to take with cloud spot. As a consumer, I am paying for their services to host my images. They made a change to their system without my knowledge that basically gave away my intellectual property.

Imagine selling prints in 2022. Lots of companies do IPS.

You can configure Pixieset for downloads in 1000, 2000, 3600 and original resolution. Don't know about ShootProof and the others.

Our pricing includes full license to download, print, share all high rez pics.
Many of the more professional galleries have metric data that track email addresses that access your pics. Try emailing clients who accessed the galleries and explain your business model for downloads.

You could explain your situation to your host provider and possibly ask for some kind of credit to your account as compensation for the error. Outside of that you could try talking to a lawyer, I'd be a little skeptical of that only because you said you don't really know for sure what your clients downloaded, so proving damage could be difficult (but I'm not a lawyer so what do I know?).

I doubt there is anything you could do on the clients end.

You signed an agreement, did you read it? Look at their Service: Updates section of their TOS.

"9. Services; Updates: Product Changes: CloudSpot is not required under this Agreement to provide any installation, training or other support services to you. Such services, if available, must be purchased separately. If, pursuant to a separate support agreement or otherwise, CloudSpot provides you with a new release, error correction, update, upgrade or other modification to the Product, such modification will be deemed part of the Product, and subject to the terms of this Agreement, unless the modification is expressly provided subject to a separate license agreement. CloudSpot reserves the right at any time not to release or to discontinue release of any of the Services and to alter prices, features, specifications, capabilities, functions, licensing terms, release dates, general availability or other characteristics of any future releases of any of the Services. CloudSpot reserves the right, in its sole discretion, to make necessary unscheduled deployments of changes, updates or enhancements to the Services at any time.
