I'm supposed to be taking some shots, or using ones I have, for a venue (pub that does concerts) to use on their website.
This made me think - when are model releases possibly required?
The various concert venues (with my consent) are tagged on concert pics of bands and fans, which causes them to appear on the venue's facebook page. Sometimes they put them in a gallery page on their website also. The bands also use my images (of themselves, and fans). So, isn't this using the images to advertise?
Is it somehow implicit or written into a contract when a band performs at a venue, that their image can be used by the venue? What about fans?
Also, what if band member(s) and/or audience members are underage?
I'm presuming the business would have some liability if it exists, rather than myself, but I want to mention it to them just in case, if necessary.
