I could use some help with a Photography Release/Waiver that will cover me for pretty much anything I guess (people wise), this is what I have come up with, I need to finalize it by tonight or early tomorrow, cause for the first time I will have to use one, please comment on it or recommend changes or anything else, I'm not really familiar with this sort of thing, the one I created for minors is pretty much the same:

Photography Release and Waiver


For valuable consideration received, I hereby grant permission to _________________________ and his assigns, licensees, and legal representatives, the irrevocable and unrestricted right to use and publish photographs, pictures, digital images in all forms, of me, or in which I may be included, for editorial, advertising, promotion, exhibition, or any other purpose and in any manner or medium.

I also grant permission to __________________________________ and his assigns, licensees, and legal representatives, to offer these photographs for use or distribution in other publications, electronic or otherwise, without notifying me.

I hereby waive any right to inspect or approve the photographs or printed or electronic matter that may be used in conjunction with them now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of the photographs.

I am 18 years of age and I am competent to sign this release. I have read this release and waiver and I am fully familiar with its contents.

Just an FYI if you google something such as "generic model release" you will find plenty out there for the taking that are already in .PDF format and ready to go. Unfortunately the one I use is on another computer or I'd host it and post a link to it.

yeah I googled and came up with a couple that I kind of merged into the one above, I was just trying to get the FMers take on it, thanks for the link to the istockphoto one, I was coming across a number of one's but you had to pay for a lot of them, anyways

is the one I did above good (would you use it)?

Your use of the word 'contents' is wrong it should say 'terms'. Also, you need to stipulate the period of the license and the countries that it is valid in; the phrase 'in perpetuity' always looks good on a license as does 'world-wide rights'.

You also state "For valuable consideration received" but do not state what is its that is received. I have seen some that use "TFP, TFCD, or a dollar amount". It is my understanding that unless you "give something" the the model, that any contract is not valid. (I am not a lawyer, this is just what I have read on the net)

It is my understanding that the reason for using "For valuable consideration received" is that it is generic in nature and can mean anything. Having said that, you might want to put this over on the Pro Digital forum and see what they have to say?

if I use this release off of gettyimages and change "governed by the laws of the state of California" cause that is where I live, wouldn't everything be good to go?

Ok so I got a finalized form together with the help of you all, pretty pleased with it

and then I start to think about my client who will be putting some photos on a website to help promote his candidacy, now if he is moving amongst a number of people at a private event along with other candidates or officials, and shaking hands with big and small crowds, I don't imagine I would be able to have everyone start signing model releases. Sorry for my lack of knowledge in this area, I'm just a novice when it comes to this sort of thing... then how do I expect to post such photos on his website?

You have certain rights for use as 'news'. I am sure someone will pop up with a link to a good explanation.

The photos at an event like that would be editorial in nature. My understanding is that model releases are not needed for editorial photos.
