UPS and lost package

p.1 #1 · p.1 #1 · UPS and lost package

I was flying across country recently and it was logistically simpler and cheaper for me to ship a large amount of my camera kit rather than carry it on the airplane. The UPS store wouldn't ship it because of the value ~11,000, told me I had to take it down to the UPS center. They took it, checked it in and it never left their building per their own tracking center. The first investigator passed it for a month, then lied to her "partner" then they have kept on putting more requirements losing paper work despite it being sent four and five times to them. I am very tired of this and am ready to sue them. They haven't responded to letters or anything else, has anyone dealt with this before?

If they're playing hardball, you may need to get a lawyer to help you out.

OP, I would certainly follow Victor's and Paul's advice, Also, assuming that you have all the documentation you got in carrying out the transaction, I suggest you contact your local Police Dept. to make contact with an Officer who can advise you of any potential criminal charges that might be placed against the workers (sic) who have signed off on their receipt of your property. If so, $11k, at least in my PD's jurisdiction, falls squarely in felony territory. Just to show these workers (sic) that you intend to pursue legal action, I would send their supervisor (simply call and ask for the head worker (sic) a certified letter, return receipt required, outlining your intention, unless your attorney advises you otherwise. Also, pending your attorney's advice, you could advise them that your are considering going public with the story. In any case, "hardball" is the correct term. When several years ago I had to send out via another carrier $4k worth of gear, when I arrived with it at the Center, the manager whom I knew from several prior contacts advised me that he would have to open the box personally to inspect the container to verify that what I had claimed for insurance purposes to be there, was indeed there. He did that, sealed the package in my presence with security tape, allowed me to insure it for full value and sent it off. It arrived within the time frame I had paid for and it was in perfect shape. It was signed for by the buyer.

So.... did you insure your package for full value? Do you have personal insurance for the equipment? If so, contact the insurance carrier to solicit there assistance. Finally (whew), at least in my local UPS, FedEx and USPS Centers, all transactions are video documented. Advise your attorney and local PD contact to seek it out. Your problem will of course be that the transaction happened sufficiently long ago so that the surveillance video will have automatically been erased. Good luck with your efforts...

$500> is a felony in Mary-land.
Now FedEx here USED to not allow sealed packages to be shipped at their FedEx stores unless inspected 1st if over $5000.
That has changed...
Good luck..pay a lawyer $100 and have him send a letter. No response go to court....YES to reporting to local LEO's. Then call "Sheriff Joe". No this is not a laughing matter...

Did that in my case and did absolutely NOTHING!! Attorney General of Maryland intervened(because UPS has facilities in Maryland and collect Maryland taxes) and not only was my money returned but UPS was fined under Maryland Consumer Protection Act.
But I still use them..All of the shipping companies have major faults.

Good for you, Dan.

Send a copy of the demand letter to UPS to the AG in Nevada and wherever UPS is headquartered. In short, start a scorched earth attack!

It is not quick and it is indeed tedious. I should have mentioned that I paid with my credit card so I immediately "disputed" the charges and was given a credit.
But UPS did the same "smoke and mirror trick" in presenting documentation to my cc company. But after about 4-5 months, UPS could NOT substantiate their case and were fined by the State of Maryland under the Consumer Guidelines.

YES! Scorched Earth policy.....
Thanks!

It was the internal UPS investigator.

They have admitted that they need to pay the claim and are being crack heads about it.

I just did small claims because getting an attorney would yes get me 500-1500 more but would take a couple of years.

We have a hearing on December 6th! I am just going to be as bad to them as I can. This POS investigator's family works for my wife and two more work for friends of mine. I am not below playing dirty and this is calling for it at this time.

That is bizarre. Las Vegas is not exactly a small town.

Well my wife is an executive with a big box store with a huge number of stores.

The two friends work for two of the top four casino operators in town so it isn't that rare. Vegas is actually a very small town compared to where I have lived for most of my career.

Before you go having his family fired please keep in mind that with an $11000 claim, I doubt, he has the last say in any approval or denial. I'm sure this one will go a ways up the flag pole as it is quite a loss.

This whole situation seems odd to me. You should have shipped your luggage and flew with your camera gear.

This seems like a personal dispute best handled in the courts, not indicative of UPS business policy.

In the states if you are traveling and have to check your luggage the total is only $1,250 and they lose stuff much more often.

I don't care, yes it is personal at this point, I am handling it through the courts now.... Updates when over.
