I wouldn't ask for a refund from the seller. You are getting a big discount buying used. He is not selling a new lens with warranty and he is not Amazon, B&H. If you want the privilege of trying different copies to get a good copy, I would buy it new from a retailer.

If I'm really concerned about it (usually in a trade situation where things are a bit more complex around 'value' of a lens) I'll ask for sample images, and specifically state beforehand what I'm looking for. I turned down one trade a few weeks back because I didn't think the lens was as sharp as my rental copy I had. It's probably plenty sharp for the guy that uses it, but it's on the buyer IMO to sort that out ahead of time.
One the flip side, I do always try and post sample images taken from the lens I'm selling to avoid this scenario from s a seller perspective. This way I can at least say that I gave the buyer the option to review a few images.
