A friend of mine grabbed this shot. Is this a male Orb Weaver or am I way off? Taken from the bay area in California.

I've been crazy busy with work but I'm still lurking here and hope I can post some new shots soon.

Only thing I'm certain of is it's a female (no bulbous palps)

Probably Theridiidae. If so, the web will have criss-cross threads, with sticky droplets near where they are attached and which break up when the web is hit by an insect. However, some species spin reduced webs or none at all.
