Not usually a big Gary Fong guy, but big props to he for testifying as an expert witness. That totally sucks.

yeah, I've never done a full shoot to burn, I've given full raw files for non weddings but culled them first.Lesson learned..

Only in the USA....Yet another reason to hate greedy lawyers!

How did the other case with the NY lawyer's son suing his photographer who missed his last dance who wanted the photographer to pay for re-staging his wedding so that he could get that shot end up?

This is despite that fact that the person was already divorced....

Depends on the state bar, but if this violates ethics rules, the more likely consequence is less severe than disbarment. Pretty remarkably bad letter, if what Fong read was fully representative.

I have always marveled at how articulate Gary Fong seems, and now I know how articulate his middle finger is too. It kind of surprised me into laughing at 6 in the morning.

Yeah, I was surprised too. Funny, I'm glad he did it in expressing his feelings about this. I completely agree with him.

Kind of doubt the guy is an actual lawyer. In any case, I feel sorry for the groom's new wife. She has to live with the prick.

Maybe this is normal for America......but I don't notice anyone, anywhere, discussing what was allegedly done wrong, is "you ruined our wedding day" really all that's required to start a suit??

I know of no lawyer, not even the "I graduated from an online course" type that would ever send out a letter so poorly written. And I'm 12 years in the legal field as my day job.

Threatening to destroy the photographer's career, defamation of character, and asking not for what is reasonable, but for compensatory damages and punitive damages of more almost 4 times what was originally paid? Ridiculous. Then threatening for $300k, as if a case like this would ever, EVER cost that much? If this "attorney" had any legal background, he would have taken the photog to small claims court for the 1-time maximum allowed judgment, and sued for that. He's using what he probably learned off of Yahoo! Answers to draft a demand letter that doesn't actually even make a demand or, per what I remember hearing Gary Fong saying, give any hard and fast deadlines.

My guess is this student is pre-law, probably finishing his undergrad somewhere, and is hoping to be out of law school by the time this ever hits trial (which it never will) so he can make some case.

The no contract thing, sure. That could hurt. But the damning evidence is in the "I'm proud of my wedding photographs so I put 1,000 of them up on Facebook."

People mortified with their wedding photographs don't share them with everyone and receive such accolades.

The letter is a pile of beans in a civil court. It doesn't address any specifics of "what" ruined the wedding day or photographs. And the poorly written, unprofessional letter when presented in court, will not even be given the time of day by any judge. It's nothing more than a scare tactic letter.

Unfortunately anyone can sue anyone in the U.S., even for farting in the same room.

I've only seen Fong's selective reading of the letter, in which Fong glosses over the client's substantive complaints, and only reads the threats and ugliness. Have you found the complete letter somewhere to review what the client claims the photographer did to ruin the wedding?

Very fair point, I know GF says the photos were great, but I'm guessing if he also stripped naked and peed on the cake, they'd probably remember that more
